The Terms in plain words

When do the DealsDMV Terms apply to me?

When you use dealsdmv.com, create an account, bid, make an offer or buy. Doing any of those means agreeing to them.

Can DealsDMV change its Terms?

Yes. A significant change is announced by email or on the site at least 14 days before it applies to you, unless the law or security needs it sooner.

Does a change to the Terms affect a bid I already placed?

No. A change never applies to a bid, offer or order made before it takes effect.

Can a staff member or the assistant change the Terms for me?

No. Only a change published on the Terms page changes them; nothing said by staff, in a message or by the Store Assistant does.

Do terms shown on an auction override the main Terms?

They add to them for that auction or lot, and win if the two conflict — except they cannot take away the arbitration section or your legal rights.

How much is DealsDMV liable for if something goes wrong?

For a claim about an item or order, up to what you paid us for it; for any other claim, up to $100 — except where the law does not allow a limit.

What do the liability limits never cover?

Death or injury caused by our negligence, fraud, deliberate misconduct, and your consumer-protection rights that cannot be waived.

Who is responsible if a carrier or Stripe fails?

Those providers run their own services; we are not responsible for their failures that we could not reasonably have prevented.

What if a part of the Terms is not allowed in my state?

Only that part, or the piece of it that is not allowed, falls away; the rest still applies.

I live in California. Where can I complain about an online seller?

To the Complaint Assistance Unit of the California Department of Consumer Affairs, in writing or by phone at (800) 952-5210.

Do the Terms apply differently in New Jersey?

Yes, in a few places: some damage limits, the indemnity for our own negligence and the one-year claim deadline do not apply there.

Can I copy photos or text from DealsDMV?

Not without our written permission. The site's text, photos, design and software belong to us or to those who license them to us.

Is a translated version of the Terms binding?

No. The Terms are written in English; a translation, such as one your browser makes, is only for convenience.

What happens to the Terms if DealsDMV is sold?

We may transfer them to a business that takes over DealsDMV; your information then passes to the new owner, who must keep to our Privacy Policy.

Are there events outside DealsDMV's control that excuse delays?

Yes. We are not responsible for delays caused by things outside our reasonable control, such as severe weather, carrier or power failures, or a government order.

Do I have to cover DealsDMV's costs if I break the rules?

If a claim is made against us because you broke the Terms or the law or misused an item, you cover our reasonable costs from it, as far as the law allows — never for our own negligence.
